SAFARI BOOKING CONDITIONS

OUR COMMITMENT TO YOU- We are committed to a policy of fair trading and make every effort to ensure that you have an enjoyable safari. Our terms of trade have been formulated as a result of our responsibilities under law and in no way affect your statutory rights as a consumer. We accept responsibility for the quality of the safaris we provide.

YOUR RESERVATION- Once you make a confirmed booking then a firm contract exists between you and Us on the terms set out in the confirmation invoice. The invoice will state the outstanding payments due and the date for payment. All safaris and offers published are subject to availability and price at the time of booking. If you wish to make any alterations to your safari we will make every effort to accommodate these but cannot guarantee that this will be possible. If alterations you request are possible these will be subject to other charges and an administration fee of £50. The person who signs the booking form must make the request in writing.


SAFARI PRICES- Prices include all safari cost, all game drives,all accommodation,all laundry and bar except in third party accomodation. It doesn't include park fees as they are paid directly either by credit card or by cash to the park authorities on arrival. Nor staff tips which are to be paid centrally to be proportionally divided amongst the staff.

VISAs- Kenya is now Visa free. You only need to obtain electronic Travel Authorisation (eTA) in advance before departing for Kenya. Full Details will be provided in the arrival notes.

INTERNATIONAL FLIGHTS- You will book your flight to Nairobi direct with the carrier or their agents. We can advise suitable flights. In the case of flight delays you will meet any extra costs involved which should be recovered via your travel insurance

INTERNAL FLIGHTS & ADDITIONAL ACCOMMODATION- All internal flights and additional accommodation will be booked by us and itemised separately on your invoice which are additional to your safari cost.

CHANGES TO YOUR SAFARI- The safari arrangements require flexibility and must allow for alternatives and are not a contractual obligation on the part of the company. We will take the final decision on the itinerary and conduct of any safari in the interest of the clients as a whole. It is understood that the route or area schedules, itinerary, amenities or mode of transport may be subject to alteration without prior notice due to local circumstances or events which may include illness or medical breakdown, weather or other local circumstances. The decision of the safari leader will be final on all matters likely to endanger the safety and well-being of the safari. Most changes are of a minor nature, which we will make every effort possible to inform you before departure. If major changes become necessary we will advise you at the earliest possible date and you will have the choice of accepting the new arrangements, or taking an alternative safari or cancelling the safari for a full refund. We consider a major change is one involving a change of departure by more than 24 hours but not a flight delay as this is covered under the insurance policy. Compensation payments do not apply to any changes caused by the air carrier or force majeure [war, threat of war, riots, civil commotion, terrorist activity, industrial disputes, natural and nuclear disasters, fire, technical problems, closure or congestion of airports, cancellation or changes by airlines or other such events outside our control].

IF WE CANCEL YOUR SAFARI- We reserve the right in any circumstances to cancel your safari. In this event, we will return to you all money you have paid to us or will offer you an alternative safari. Your safari will not be cancelled within 8 weeks of departure except for the reasons quoted above or in very exceptional circumstance in which the minimum number of bookings required to run a safari are not met. If this applies to any safari it is noted in the costing.

PERSONAL INJURY- We have taken all reasonable and proper steps to ensure that proper arrangements have been made for the entire safari and that they comply with Kenyan law. However subject to the note below we will pay to our clients the equivalent of such damages as they would be entitled to receive under English law in an English court for any personal injury to our client, including death, caused by negligence, as understood in English law, of the servants or agents of ourselves or of any suppliers contracted or sub-contracted by us to provide any part or the arrangements for your safari, except for air transport arrangements for which separate conditions apply. We will make payment provided we are informed of any injury within one month of your return date, you assign to us any rights against a supplier or other person or party that may have relating to the claim and they agree to co-operate fully with us should we or our insurers wish to enforce those rights which have been assigned to us or which we are subrogated. If any client suffers personal injury including death whilst overseas arising out of an activity which does not form part of the inclusive safari, which is the a result of your fault, which is the responsibility of a third party unconnected with the safari arrangements, or due to unusual or unforeseeable circumstances which neither we, nor our servants, agents or suppliers could anticipated or avoided even with the exercise of all due care. We will give you help in your resolving of any claim you may have against a third party.

YOUR COMMITMENT TO US

BOOKING FORM AND PAYMENTS- We do require a booking form to be completed which you undertake to forward with whatever monies are due to us at that time, on receipt an invoice will be sent by return of post or E-mail. The person making the booking accepts these terms on behalf of all those party to the booking. A non refundable 20% deposit is paid on booking, and the balance must be paid at least ten weeks before departure otherwise we may cancel the booking, and you will be liable for cancellation charges of all your deposit.

TRAVEL INSURANCE- You agree to be covered adequately by personal insurance and you agree to include the Kenya Flying Doctor Service in your booking.

BEFORE YOU BOOK- It is the responsibility of all our clients to ensure they have a valid passport and documentation and can obtain any required visa. In addition you must consult your doctor for advice regarding recommended medication and anti malarial drugs before you book. You acknowledge that the nature of the safari is adventurous and that as such may involve a significant amount of personal risk. These include injury, disease, loss or damage to property, inconvenience, and discomfort.

IF YOU WISH TO CHANGE YOUR BOOKING- All amendments to your booking e.g. name, dates of departure, must be requested in writing and will incur a charge the amount of which will depend on the nature of the change and the date written confirmation is received before the date of travel. If a name change is made it will be subject to an administration fee, if all names change on the booking, then cancellation charges will apply. Any alterations made within eight weeks of departure may be treated as cancellations and rebooking. Any flight changes have to be taken up direct with the airline and subject to the booking conditions applicable to that fare.

IF YOU WISH TO CANCEL YOUR SAFARI- Cancellations must be notified in writing and the following charges will apply to the safari from the date the cancellation is receipt by us.

29 to 55 days.....50%
14 to 28 days.....90%
0 to 13 days......100%

YOUR TICKET CONDITIONS- When you travel with an air carrier, their Conditions of Cancellation and Carriage apply, some of which limit or exclude liability in accordance with the relevant international conventions. You will have to deal direct with the air carrier.

IF YOU HAVE A COMPLAINT- In the unlikely event you have a complaint whilst on safari you must refer it to the safari guide as soon as possible to enable them to resolve any problems immediately while you are still on safari. It is unreasonable for you to take little or no action whilst you are on safari and wait until you return to complain. If a problem cannot be resolved locally, you should give written notice that you shall on your return and within 28 days make a complaint in writing to this office. We regret that complaints made outside this period cannot be accepted.

Please Note: Any person over the age of 16 is classed as an adult. Exclusive group bookings can include children of all ages and special rates may be available in these circumstances. Due to local VAT rules the safari fee will be exclusive of the park/bed fees which are $70 per day per adult.
